Binacional would return to the First Division, while Cusco FC would be relegated to Second Division, according to CAS (Court of Arbitration for Sport) decision

Lausanne-based CAS (Court of Arbitration for Sport) ruled in favour of Cienciano and Deportivo Binacional and against the Peruvian Football Federation and Cusco FC in the case related to the use of player Mathías Carpio by Cienciano in their match against Cusco FC.

The match was played on 27 August 2021, and it counted for round 9 of Stage 2 of the Peruvian First Division. The final score was 2-2. Mathías Carpio entered the game as a substitute for Cienciano in the second half. After the match, Cusco FC contested the use of the player by Cienciano to the Peruvian Football Federation. The Peruvian Football Federation ruled in favour of Cusco FC, and awarded the match 3-0 to Cusco FC.

Cusco FC saved themselves from relegation with the help of those two points, in the last round of Stage 2, on goal difference. Binacional and Universidad de San Martín, which had the same number of points, were relegated, because of the worse goal difference. This was the aggregate table at the end of the 2021 season of the Peruvian First Division (Liga 1):

It must be also said that Deportivo Binacional lost the relegation/promotion play-off against Carlos Stein and were therefore relegated.

Cienciano, together with Deportivo Binacional and Universidad de San Martín, appealed to the Lausanne Court of Arbitration for Sport regarding the use of Matías Carpio.

The Court of Arbitration for Sport ruled in favour of Cienciano and Deportivo Binacional, and against the Peruvian Football Federation and Cusco FC. Therefore, the result of the match Cusco FC - Cienciano should be reversed to 2-2, as it ended on the field, instead of 3-0.

Cienciano gained one point, which is not much. Their final position in the 2021 aggregate table remains the same, sixth, with 39 points (instead of 38), which allows them to play in the 2022 Copa Sudamericana. Their only success is to see their city rivals, Cusco FC, relegated to the Second Division. This might worsen the relations between the two clubs within the city of Cusco.

The biggest winners are Deportivo Binacional. In the new 2021 aggregate table, they are classified 15th, above the relegation line, and they should be back for the 2022 season of the Peruvian First Division, even though they lost the relegation/promotion play-off against Carlos Stein. However, they only have two weeks to prepare for the First Division.

Alianza Atlético would also move up one place, from the 15th to the 14th, but this has no serious consequences.

Universidad de San Martín de Porres would advance in the 16th position in the new 2021 aggregate table, which is the place that allows for the relegation/promotion play-off. Nevertheless, the Court of Arbitration for Sport did not rule in their favour, and stated that their request was ”inadmissible”. This might mean that they cannot play the relegation/promotion play-off, so they are still relegated, while Carlos Stein (which won the play-off against Deportivo Binacional) would play in the First Division.

The biggest losers of the whole issue are Cusco FC, along with the Peruvian Football Federation. After several months in which important players were brought in to improve the squad for the 2022 season of the First Division, Cusco FC would drop into the 17th position in the new 2021 aggregate table and are relegated to the Second Division. They are now in big trouble and they have to rethink the whole season, apart from paying important amounts of money as court fees to city rivals Cienciano and to Deportivo Binacional. There is a small chance that the Peruvian Football Federation would enlarge the 2021 First Division to 20 clubs, accepting both Cusco FC and Universidad de San Martín de Porres. This is however unlikely, given that last year Carlos Stein were relegated even after the start of the 2021 First Division, also according to a decision made by the Court of Arbitration for Sport.

A clarifying decision from the Peruvian Football Federation is expected.
